Legal Notice

In accordance with the provisions of Article 6, III, of Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (known as the "LCEN"), this Legal Notice informs the users and visitors of the ThumbLead website, accessible at https://thumblead.com (hereinafter the "Site"), of the identity of the various parties involved in its creation, publication and monitoring.

The Site is published and operated as online software (SaaS) intended for professionals in YouTube thumbnail design (prospecting of YouTube channels, analysis of thumbnails by artificial intelligence, customer relationship management, invoicing, calendar and prospecting e-mail sequences).


Article 1 — Publisher of the Site

The publisher is also referred to in this Legal Notice and in the other contractual and informational documents of the Site by the terms "ThumbLead", "the Publisher", "we" or "the Seller".


Article 2 — Publication Director

The publication director of the Site, within the meaning of Article 6, III, 1, of the LCEN, is:

The publication director is responsible for the editorial content posted on the Site.


Article 3 — Host of the Site

The hosting of the Site and of its database (PostgreSQL database) is provided by:

The host is located in the United States. The data stored in connection with the operation of the Site (in particular the PostgreSQL database) is therefore transferred outside the European Union, subject to appropriate safeguards (in particular the standard contractual clauses adopted by the European Commission). For further details on the processing of personal data and transfers outside the European Union, users are invited to consult the Privacy Policy of the Site (see Article 5 below).


Article 4 — Intellectual Property

4.1 Ownership of rights

All the elements making up the Site (structure, tree layout, source code, interfaces, texts, logos, trademarks, graphics, illustrations, icons, photographs, sound and video elements, databases, as well as their arrangement) are protected by intellectual property law, in particular by the French Intellectual Property Code (Code de la propriété intellectuelle) and by trademark law. These elements are the exclusive property of the Publisher or are subject to an authorisation of use, with the exception of elements belonging to third parties (see Article 4.4).

The name "ThumbLead" and, where applicable, the associated logo constitute distinctive signs; the name "ThumbLead™" has not yet been the subject of a trademark filing with the INPI (the French trademark office), but remains protected under copyright law and the rules relating to unfair competition and free-riding. Any unauthorised reproduction or use of these signs may constitute infringement within the meaning of Articles L. 713-2 et seq. of the French Intellectual Property Code.

4.2 Rights granted to the user

Access to the Site and use of the service confer on the user a mere right of use, personal, non-exclusive and non-transferable, under the conditions set out in the General Terms and Conditions of Sale and Use. No provision of this Legal Notice may be construed as a transfer of intellectual property rights to the user.

4.3 Prohibitions

Except with the prior written authorisation of the Publisher, the following are notably prohibited: the reproduction, representation, adaptation, modification, translation, distribution, extraction or reuse, in whole or in part, of any element of the Site, as well as any commercial exploitation of these elements. Any unauthorised use engages the liability of its author and may give rise to legal proceedings, in particular on the grounds of infringement.

4.4 User content and third-party elements

The content created, imported or entered by the user in connection with their use of the service (in particular the contact and order records of their CRM, invoicing documents, and thumbnails submitted for analysis by artificial intelligence) remains the property of the user or of their respective owners. The user is solely responsible for the lawfulness of the content they process by means of the service and warrants that they hold the rights necessary for that purpose.

Certain features rely on third-party services and technologies (in particular Google, for the Gemini artificial intelligence, Google/OAuth login, and Google Calendar; Stripe, for payments). The trademarks and elements belonging to these third parties remain their exclusive property.


Article 5 — Personal Data

The Publisher acts as data controller for the personal data collected and processed in connection with the operation of the Site, in compliance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and Law No. 78-17 of 6 January 1978 as amended (the French Data Protection Act, "loi Informatique et Libertés").

The procedures for the collection, processing, retention and transfer of personal data, as well as the rights available to the user (rights of access, rectification, erasure, portability, objection and restriction, as well as the right to lodge a complaint with the French Data Protection Authority — Commission nationale de l'informatique et des libertés, CNIL), are detailed in the Privacy Policy of the Site, accessible at: https://thumblead.com/confidentialite.

Article 6 — Cookies

The Site mainly uses technical cookies and trackers necessary for its proper functioning (in particular the management of the authentication session and the storage of the user's preferences). The Site does not use third-party advertising cookies.

Information relating to the use of cookies and trackers, as well as, where applicable, the procedures for obtaining consent and configuring settings, is detailed in the Privacy Policy of the Site (see Article 5 above).


Article 7 — Liability

The Publisher endeavours to ensure the accuracy and updating of the information published on the Site, as well as its availability and security, without however being able to guarantee the complete absence of error, interruption or unavailability. The conditions of use of the service, the applicable warranties and the limitations of liability are set out in the General Terms and Conditions of Sale and Use of the Site.

The Site may contain links to third-party sites or interface with third-party services (in particular Google, Stripe, Railway, Resend). The Publisher exercises no control over these sites and services and disclaims all liability as to their content, their availability or their data protection practices.

Article 9 — Governing Law and Competent Jurisdiction

This Legal Notice is governed by French law. The reference language, in the event of translation, is French.

In the event of a dispute, and failing prior amicable resolution, the French courts shall have jurisdiction under the conditions provided for by law. As the Service is reserved for professionals acting for the purposes of their business, the provisions of the French Consumer Code relating to consumer mediation do not apply. The procedures for settling disputes are set out in the General Terms and Conditions of Sale and Use of the Site.
